Terms and Conditions for API Usage
- Acceptance of Terms: By using the DataMC API (“API”), you agree to these terms and conditions. If you do not agree to these terms, you should not use the API. DataMC reserves the right to update and change these terms from time to time without notice.
- License Grant: Use of the API is strictly subject to obtaining prior written permission from DataMC. Upon receiving such permission, DataMC grants you a non-exclusive, non-transferable, limited license to access and use the API solely to develop, test, and support your software application, website, or product, and to integrate the API with your application, website, or product, in accordance with these terms. Any use of the API without prior written permission from DataMC is expressly prohibited.
- User Obligations: You agree to comply with all applicable laws and regulations in your use of the API. You will not use the API for any illegal, unauthorized, or otherwise improper purposes, or in any manner which would violate these terms, or breach any laws or regulations, or infringe any third-party rights.
- Data Protection: You agree to comply with all applicable data protection laws and regulations in the UK, including the General Data Protection Regulation (GDPR), in relation to any personal data processed by you in connection with your use of the API. You must ensure that you have all necessary consents and permissions to process such data.
- Security: You must use reasonable security measures to protect against unauthorized access to or use of the API. You must promptly report to DataMC any security deficiencies or suspected unauthorized access to the API.
- Limitations: You may not use the API in a manner that exceeds reasonable request volume, constitutes excessive or abusive usage, or otherwise fails to comply or is inconsistent with any part of the API documentation provided by DataMC.
- Termination: DataMC may terminate or suspend your access to the API at any time, for any reason, without notice. Upon termination, all rights and licenses granted to you will terminate immediately.
- Disclaimer: The API is provided on an “as is” and “as available” basis. DataMC makes no warranties, express or implied, as to the reliability, accuracy, or completeness of the API, and you agree to assume all risks associated with your use of the API.
- Indemnity: You agree to indemnify and hold harmless DataMC, its officers, directors, employees, and agents from any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorney’s fees) arising from your use of the API, your breach of these terms, or your violation of any law or the rights of a third party.
- Governing Law: These terms are governed by the laws of the United Kingdom, without regard to its conflict of laws principles.
